| Okay, was driving down some country roads, for a basic drive, came around a corner, doing 35 (was a national limit road) and a focus appeared i immediately swerved left, he didnt move a inch despite being able to move a good 2 foot to the right, i was at this point digging into the embankment, i also had my wheels locked (but pumping the pedal) to desperately try and get the car to stop! this point both sides clashed The damage to my car, is scratches on the front arch, mirror totally gone, huge dent in door, door locked smashed up, crease in door, scratches all down the rearquarter and my light dislodged Damage to his car are, rear bumper is clipped creased (bent back) crease in rear quarter He was a good 60 year old bloke, and not being from the area anyway heres the pictures         I'm addiment its knock for knock 50/50 my neck has also started causing me problems while driving this evening, worth a trip to the doctors? So need to know where i stand thanks luke |

| there are exceptions to the rule on country roads depending on action taken at the scene. as luke has photo's of where he ended up it will bolster his case that he tried to avoid a crash. (Did you take photo's of the whole scene with the cars?)
TBH the damage to yours would show that you ended up in the hedge anyway were as he would only have damaged to the side that hit you. were there any skidmarks etc? photos of those could help as it would show where he was in the road in relation to you. (biggest issue in modern car accidents is ABS etc as most of the time there are sometimes no skidmarks).

| Nightmare but as you said will be 50/50 i work in insurance. And narrow lanes collisons always go 50/50 in less there a witness or something. But if you have photos to show you did try to avoid the accident and the other party well never did anything that could help your case. Might aswell go to the doctors you can still claim up to 50% of your injury. Feel your pain some guy pulled on to a round start of august and both our cars collided i was gutted aswell as being rather p*ssed off. I took photos and got a witness but he disputing liability. Anyway did you decide to claim or just leave it? _________________  Planned mods: Fit Coilovers, Get roof & spoiler re-wrapped Gloss Black, Spray front Audi badge Volkswagen Canyon Red & Sort out interior.
